Bytes and Pieces Limited Terms and Conditions of Trade

Terms Used

The seller refers to BYTES and PIECES Limited or any legitimate agents or employees thereof.

The buyer refers to any legal entity purchasing from the seller

Goods and Services Tax:

All prices published or advertised are exclusive of GST and freight costs.

 

Prices and Payments:

Terms are payment in cash or credit card prior to dispatch of goods unless the buyer has an approved credit account with Bytes and Pieces Limited.
If the buyer has an approved credit account then a purchase order must be provided at the time of order.

Bytes and Pieces make all effort to ensure the prices and specifications of goods are as accurate as possible.  We reserve the right to make updates as required without notice.  No liability will be accepted due to the unavailability of goods or for price or specification variations arising from circumstances beyond the control of The Seller.  Every effort is make to ensure the accuracy of all advertising or notified prices however The Seller accepts no liability in the event of prices or specifications differing from those presented on our website.

Quotations:

Where a quotation is provided by Bytes and Pieces Limited for products or services:
Unless otherwise agreed or stated the quotation shall be valid for thirty (30) days from the date of issue.

The Quotation shall be exclusive of GST and freight unless otherwise specifically stated to the contrary.

Bytes and Pieces Limited reserves the right to alter or amend the quotation in the event of circumstances beyond its control.

Freight and Delivery:

Orders will be dispatched by courier in order to achieve prompt delivery.

A guideline for delivery date will be given at time of purchase but this is an estimate only and the seller shall not be bound by this advice.

The seller reserves the right to dispatch the buyer’s order in one delivery in total or by instalments. Failure to deliver any instalment shall not entitle the buyer to repudiate the contract as to any instalments already delivered.   The buyer may cancel any undelivered instalments.

Chairs and all or any other products presented on our website as unassembled or as requiring assembly will be dispatched in such condition and The Buyer accepts responsibility for assembly.

Shortages, Damages or Loss in Transit:

No Claim for shortages in quantity will be allowed unless the buyer gives notification of the shortage in writing within 7 days of the delivery and provides a reasonable opportunity for the seller to investigate the claim.

Goods leaving the seller’s warehouse will be adequately and sufficiently packaged.  Claims for damage or loss in transit must be made against the carrier. Upon accepting the delivery the buyer must ensure that the order is complete as per the packing slip on the order.  Should there be a shortage or visible damage to the outside packaging the carrier’s note must be recorded in writing accordingly.

Within 7 days of receipt of order the buyer must ensure that all goods received are in good order and condition.

No Claims will be considered after 7 days of receipt of goods. While no liability for goods damaged or lost in transit will be accepted by the seller details of any claim should be advised to the seller.

Return of Goods and Credit Policy:

Goods supplied in accordance with the buyer’s order can only be returned with the express and prior approval of the seller.

Requests to return goods must be submitted within 7 days from the date of supply and the original invoice number must be quoted.

The goods must be returned in the condition in which they were delivered and with all original packaging unopened. Goods accepted for return shall be in original and re-saleable condition.

Where goods are accepted (for credit or refund at the seller’s discretion) they must be delivered at the buyer’s expense into the seller’s store, or any other place nominated by the seller.

The seller reserves the right to levy a restocking fee against any returns the seller may agree to accept.  Such fees may be up to 15% of the invoice priced and levied at the seller’s absolute discretion.

Consumer Guarantees Act 1993 (“the Act”):

Where the goods or services have been acquired for the purpose of business then the Act shall not apply.  In these circumstances the only warranty offered by Bytes and Pieces Limited is the manufacturer's warranty accompanying the goods, and in no event shall the liability for direct or consequential damages exceed the price paid for the goods.
 

Privacy Act:

The buyer authorises Bytes and Pieces to collect, retain, and use information pertaining to the buyer for the purpose of confirming the buyer’s credit status with a credit agency.  All personal information you have supplied to the seller may be held to check the Buyer’s credit worthiness.

 

Personal Property Securities Act 1999:

Until full payment has been received in respect of the goods supplied the buyer acknowledges and agrees that:

    These terms and conditions constitute a security agreement for the purposes of
    section 36 of the Personal Property Securities Act 1999; and a Security Interest is
    taken in all goods previously supplied by the seller to the buyer (if any) and all goods
    that will be supplied in the future by the seller to the buyer during the continuance of the
    parties relationship:

The Buyer undertakes to:
    Indemnify, and upon demand reimburse, the seller for all expenses incurred in 
    registering a financing statement or financing change statement of the PPSR or
    releasing any goods charged thereby.
